Still thinking about the inxpress cease and desist letter. It may not be so much of a threat but how is such a thing possible? I have had an email response from Ben Bradshaw, my local MP, and I think he might at least consider implications for future legislation it it turns out that a court would support a change in the domain name ownership. But I still remember the debate around the Digital Economy Act towards the end of the Labour Government.

You can see from the Wikipedia that it was almost entirely about protecting the copyright of large organisations. Almost nothing came across about support for social media in the UK. The same sort of thing continues. I think Hunt is genuine about the potential for local television but then it seems to be about a national channel or protecting the regional press or ITV. Internet TV may follow some broadband boost after 2012 . Something like that. Actually there is already quite a lot of local video that can be found on various search terms. I suggest EX1to4 for most of the Exeter area.

Part of the http://www.inxpress.co.uk site is for Rougemont Global Broadcasting, an experiment in local TV or actually my bit of YouTube - youtube/willpollard . My name is Will Pollard so I guess combining the words will and pollard is ok at the moment.

So far there is not much official support for such projects. Exeter City Council do not link to YouTube on their website for bandwidth reasons and Flash is not supported on council screens. So it is not easy to explain links to animation for example.

During the elections there may be more use of social media. YouTube might slip into Facebook. So acceptance for online video may change over time.

But notice we are just putting UK content into structures owned in the USA. There could be more support for local UK attempts, however small. 

I wonder if Tom Watson has any plans to visit Devon?


 

inxpress #inxpressip polo as sweet or car there is no confusion

I have been told a bit more about trade marks. There can be trade marks for the same word in different trading sectors. Polo as sweet or car for example.

The trade mark for InXpress Global Pte. Ltd relates to class 35 and class 39, franchise and freight. So there is no confusion with an internet cafe.

Seems clear enough. But I wonder if they could get an injunction without me knowing about it. there was no procedure to inform an existing domain - http://www.inxpress.co.uk - that an inxpress trade mark was being considered. I think this should be looked at if the 1994 legislation is updated.

EPUB 3 that is all in caps - EPUB - London Book Fair info please

The news as it seems to me is that EPUB 3 is announced. To be released in June. the growth in ebooks followed New York discussion on standards.

HP at London Book Fair, what about Espresso, Blackwells actual Charing Cross Road?

From web browsing I find there are HP meetings at the London Book Fair.

But there is nothing obvious about the Espresso machine as promoted a couple of years ago and bought by Blackwells for Charing Cross Road. I think that Konica Minolto was the basis for that one. HP announced something at IPEX. So what next? The idea of a bookshop as a printing site is interesting. But I can't find any info

any mobile phone to any print device? no problem   but i still think an actual instant book on request by going to Charing Cross Road has an appeal

Sorry this blog is so brief. I am having to concentrate on inxpress.co.uk and the cease and desist letter. So no visit to LBF this year.

Some guidance back from emails re use of "inxpress" as part of www.inxpress.co.uk . Apparently there is a free half hour from the Institute of Trade Mark Attorneys but the next convenient date for me will be in July. The procedures following the Trades Mark Acts of 1994 do not include any notification to existing websites of a proposed trademark. Presumably this suits lawyers as websites would need to establish trade marks as well as registering a domain name.

There is common law about "passing off". I don't think though that there is any confusion. A freight company is not the same as an archive for an internet cafe that is no longer possible to find in any physical space. It just happens to be the first internet cafe in Exeter so has some historic local interest. It is also the base for various other projects that continue ideas first discussed there. So I think the "passing off2 would be if InXpress Global Pte. Ltd was able to present inxpress.co.uk  as if it had always been a site for their company. I can claim this as a possibility because they tried to buy the domain before sending the cease and desist letter.

But why should there be any legal dispute over the words? There are other domains  including inxpress that are working well. Dotcom and soforth. The words in, international, internet and express are widely used. Will every word become a continuing story of legal fees? Is this really intellectual property or likely to increase applied technology?

There is a point to all this. Apparently there is some support for local media in the UK and awareness that video can be online as well as proper telly. But the political discussion is almost always about large companies and how to protect copyright. This was my impression of the Commons debate towards the end of the Labour government as well current discussion. How will any local project develop brands or identity or hang on to a website without a team of lawyers to check if global operations have filed the appropriate fees?

Of course the cease and desist letter was sent on April 1st so I may be over reacting.

#inxpressip refers to the intellectual property around inxpress and is in itself not the same word so presumably can be used on Twitter.

Could I continue to use them? will the Royal Mail realise that post codes are quite useful in defining space? Is there a fee for inventing an are called EX1to4? Please get in touch if so. I am not intending to start a post code operation. No confusion intended. 

wifiexeter is a blog and some links. It was once discovered that Exeter had the highest number of hotspots per capita in the UK. Except that many of theme turned out to be pub quiz machines. Nowadays Exeter wifi is about normal for north Europe.

Touchpad II arrives in Heavitree. One left at Cobalt today

I have bought a Touchpad in Heavitree and realised that things have moved on quite a bit. Cobalt seem to be a services company that happens to be located in a shop so they have a few items for sale. They are suitable set up for Microsoft support but also have an interest in Android. The Touchpad is made and designed in China. the price is very reasonable.

Meanwhile in the Exeter High Street ( about half an hour away from Heavitree) there is an Apple Store and also several shops for mobile devices. But anything with a large screen seems to run Windows. Open source netbooks have gone though you can always download something for yourself. There was a Toshiba device but this has gone also. 

Apparently Cobalt only bought ten items so this is not really a challenge to the High Street. but they seem to be interested enough in Android to follow what is available. Stange or what? I used to think I had to travel to find current technology. Clearly Android is available in many other places. Mac and Windows will continue anyway. But the Android future has arrived close to home.

This is of interest for the people of Exeter I think. Part of local history.

Unless it turns out to be an April Fool joke that I don't find funny, the letter from InXpress Global Pte warns that there may be an "injunction ...destruction of all documents containing the infringing signs.."

How will this work. They could come to my house and destroy photographs of the shopfront ( now a Juice Bar by the way near Central Station)

But could they get to the Wayback Machine and falsify history if they get the domain? I think getting the domain may be at least part of their concern.
